Child Support Liens

So the "ex" is behind on those child support payments she or he was ordered to make. What can be done?

If there are arrearages, that is, child support that has not been paid, you may file a child support lien notice.

The lien is on real and personal property of the person owing the support for all amounts of child support due and owing, including any accrued interest, whether the amount of the arrearage has been adjudicated or otherwise determined.

Only property that is not exempt under the Texas Constitution or other law may be attached

So what can you get at? Here are a few examples: bank accounts may be frozen up to the amount of the child support lien, and the bank can be ordered to pay the amount of the arrearages from that account.

The child support lien notice can be filed in a probate court action to attach to the person's claim or potential right to proceeds from an estate.

Liens also attach to

  1. Bank Accounts
  2. IRAs
  3. Proceeds of a Life Insurance Policy
  4. Personal Injury claims

The lien can also be filed with any governmental agency that issues or records certificates or titles showing ownership.

Meet Kim Cleaver, Paralegal
Experienced in Family Law

I have added a new member to my staff. Kim Cleaver is a paralegal who has been working in the legal business for eleven years. Her years of experience working with family law clients and cases make her a great asset to this firm.

Kim and I will work as a team with clients and in preparing documents. We sit down with each other at least once per week to discuss the status of each client's case and our plan of action for the coming week.

Kim received her legal assistant certification in 1994 from the University of Texas at Arlington. She has worked in the Law Office of Kay Lynn Boll and was the head legal assistant in the family law division at the Bedford office of Bailey & Galyen.

I am pleased to welcome her to the firm.

SEPTEMBER 11, 2001

In the days leading up to September 11, I was anxious and somewhat sad. September 11 is my mom's birthday. She died last year on October 9, so this was her first birthday since we lost her. I was missing her and sad about not being able to celebrate her birthday with her.

Of course, we all know now that we can't hear the date September 11 again without thinking of our nation's tragedy.

That morning as I heard about first one plane crash and then the others, thoughts of mom's birthday were pushed out of mind so that I could grapple with the events happening in New York, Washington, D.C. and Pennsylvania.

My gut told me what to do. I rushed to my children's schools that morning to get them. I didn't know what would happen here in Fort Worth, if anything. All I knew was that I wanted my girls close to me, and I wanted all of us to be together in our home.

I miss my mom very much and still grieve the loss. She had a full life, dying at the age of 79. In her final days all of her children visited her. Those who died on September 11 did not have what my mom had. Their lives were cut short, most of them without a chance to say goodbye or be surrounded by their loved ones in their final moments.

September 11 will always be a day for me to celebrate my mom's life. Now it also is a day for me to remember those who died. I can't make sense of what happened, but I can hold my children closer and tell them I love them until they are almost tired of hearing it.

One thing September 11 made me realize is that we don't know how much time we have. This thought makes me want to treasure each day and not waste time on the small stuff.

My wish for you is that you make the most of each day you are given, that you spend your time giving love to one another, and that your children are close enough to hug often.
