A prenuptial agreement isn't all bad: Your attorney can help

Prenuptial agreements might seem hard to talk about. Some people believe that asking for a prenuptial agreement is as good as saying to your partner, "I don't trust you." The truth is that there are plenty of reasons to seek a prenuptial agreement, from protecting yourself to helping protect your partner in the future.

It can be difficult to bring up a prenuptial agreement, but if you are reasonable about it, your future spouse should see the benefits of choosing a prenuptial agreement and why it's a smart choice for them, too.

What are the benefits of prenuptial agreements?

Prenuptial agreements have a few benefits including:

  • Giving you time to talk about important aspects of marriage, such as how you want to handle assets, how you want to raise your children or other important factors
  • Discussing your current debts and assets
  • Talking about expectations in case you separate
  • Talking about expectations during the marriage

Prenuptial agreements can protect you from each other's debts, assign assets to specific people in advance and even discuss how you want to handle asset distribution in the event of a divorce.

While it's sometimes awkward to bring up something like a prenuptial agreement to a future spouse, there's no reason that it should be seen as a lack of trust. A prenuptial agreement has many positive aspects that both people should agree are in their best interests. When you're ready to have one drawn up, talk to your attorney. You should both seek out your own attorneys to review the agreement before you sign.
